Matthew Hayes

AJ Park Law Limited, Wellington

We are tremendously sad to announce that our friend and colleague Matt Hayes passed away on Sunday 31 January 2021. Read more.

Dynamic, outgoing and driven, Matthew likes turning ideas into actions and outcomes.

As a principal in AJ Park's litigation and dispute resolution team, Matthew specialises in resolving all kinds of disputes relating to intellectual property (IP)—patents, trade marks, copyright, designs, misleading advertising and product claims, counterfeit goods, theft of confidential information, and regulatory issues.

Matthew helps clients across all industry sectors, and has specialist copyright expertise in the areas of information and communications technology, software, and the media/creative/design industries. Matthew also helps major sporting organisations and brands protect and leverage their IP rights.

Matthew has represented clients before the District Court, High Court, the Court of Appeal, the Intellectual Property Office of New Zealand, and IP Australia.

His biggest case to date, and one of New Zealand's most complex IP cases, involved helping Fisher & Paykel Finance successfully defend allegations of copyright infringement and misuse of confidential information in relation to the Q-Card consumer finance software platform.

Working style

'One of the first people I worked with said litigation is 90% preparation and 10% on the day. I swear by it. It applies to everything in life.'

'No one wants to be tied up in litigation, but sometimes you have to make a stand. When I get stuck into a case, I love the detective aspect of looking at all the evidence and tying together the different strands to prove or disprove something.'

'I like to work with clients to solve problems in a way that suits their needs and their business objectives. I enjoy figuring out the best strategy, and it often requires out-of-the-box thinking. It also means getting matters resolved quickly, cost effectively?and out of the limelight most of the time. I also enjoy getting into court. It keeps you on edge and forces you to think on your feet.'

Beyond work

When Matthew's not at work, you'll find him jumping off the Days Bay wharf in Wellington with his young sons, or surfing around the wild coastlines of Wellington and the Wairarapa.

Other credentials

Matt debuted in the?enforcement and litigation table?of the 2020 edition of the WTR 1000, an annual list of the world’s leading trade mark experts.??

What Matt's clients have to say

Working with Matt Hayes and the team at AJ Park meant we were able to get clarity on our current IP position to ensure we could launch in different markets with a strong position. This involved protecting different aspects of our product to make us distinctive from our competitors

- Steven Korner, Method Ltd

Working with Matt and the team at AJ Park has been a breeze. From the first conversation the process was simple, and once the process was agreed they just got on with it and did the work. Would work with them again in a heartbeat.

- Herman Visagie, TSB Bank

We've been working with Matt for over ten years and he is always a pleasure to work with. He provides top quality counsel and advice on legal issues which cover all aspects of IP including patents, design registration and copyright litigation matters. We would highly recommend Matt to anyone seeking IP legal counsel.
